These Terms and Conditions govern the use of KenyanTutors.com and related services. By accessing or using the website, users agree to be bound by these Terms.

1. Definitions

In these Terms: “Platform” means KenyanTutors.com; “Tutor” means a person offering tutoring services; “Student” means a learner or a parent/guardian acting on the learner’s behalf; “User” means any visitor, tutor, student, or account holder.

2. Scope of the Platform

KenyanTutors.com is a tutor discovery and support platform. It provides tools to publish tutor profiles and to support communication and discovery. The Platform does not guarantee that a Tutor will receive enquiries or that a Student will find a suitable Tutor.

3. Payments and Commercial Arrangements

At this stage, the Platform does not process payments. Lesson arrangements and payments are agreed directly between Tutors and Students/Parents. Tutors set their own rates, availability, and terms, and operate on a self-employed basis.

4. Eligibility and Accounts

• Users must provide accurate information when creating an account or submitting forms.
• Users are responsible for maintaining the confidentiality of their login credentials.
• The Platform may suspend or terminate accounts that breach these Terms or pose security, fraud, or safety risks.

5. Tutor Responsibilities

• Tutors must provide truthful and accurate profile information, including qualifications and experience where claimed.
• Tutors must comply with applicable laws and act professionally in communications with Students/Parents.
• Tutors are solely responsible for the tutoring services they provide, including lesson content, delivery, scheduling, and outcomes.

6. Student and Parent Responsibilities

• Students/Parents must provide sufficient information about learning goals, level, and required topics to allow Tutors to plan appropriately.
• Students/Parents must act respectfully and refrain from abusive, discriminatory, or unlawful conduct.
• Students/Parents are responsible for verifying that a Tutor meets their requirements before engaging their services.

7. Acceptable Use

• Users must not upload malicious code, attempt unauthorised access, or disrupt Platform services.
• Users must not post unlawful, harmful, defamatory, or infringing content.
• Users must not misuse contact details or send spam, harassment, or unsolicited marketing.

8. Content, Profiles, and Intellectual Property

Tutors retain ownership of their original content, but grant the Platform a licence to display and distribute profile content for the purpose of operating the Platform. The Platform branding, layout, and software are owned by the Platform operator and must not be copied without permission.

9. Disclaimers

The Platform is provided on an “as is” and “as available” basis. The Platform does not warrant uninterrupted service, accuracy of all user-provided content, or specific academic outcomes. Students and Parents should conduct their own due diligence before engaging a Tutor.

10. Limitation of Liability

To the extent permitted by law, the Platform operator is not liable for indirect, incidental, consequential, or special damages, or for disputes between Tutors and Students/Parents. Where liability cannot be excluded, it will be limited to the minimum permitted by law.

11. Suspension and Termination

The Platform may suspend or terminate access where a User breaches these Terms, where required by law, or where necessary to protect the Platform, Users, or third parties.

12. Privacy and Cookies

The handling of personal data is described in the Platform’s Privacy Policy and Cookie Policy. Users should review those documents to understand how data is collected, used, and stored.

13. Changes to These Terms

The Platform may update these Terms from time to time. Where appropriate, updated Terms will be published on the website. Continued use of the Platform after changes are posted constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws applicable to the Platform operator’s jurisdiction. If a dispute arises, the parties will attempt to resolve it amicably before pursuing formal legal action.
